SAN FRANCISCO (KRON) -- A San Francisco police officer refused to testify this week for the trial of Richard Everett. The officer's refusal prompted prosecutors to dismiss the case on Thursday, just one day after a jury heard opening statements, according to the San Francisco Public Defender's Office. The officer was supposed to testify about the night of August 28, when San Francisco Police Department officers opened fire on Everett. Everett was armed with a knife in the Tenderloin neighborhood when officers surrounded him, gave conflicting and confusing commands, and shot him five times, defense attorneys said. Deputy Public Defenders Nuha Abusamra and Anthony Gedeon said police never told Everett he was under arrest, and he was trying to walk away when officers shot him. The 54-year-old man was charged with resisting arrest, threatening an officer, and carrying a knife. (KRON) -- A man was injured after a shooting Wednesday evening near the Cow Palace, the Daly City Police Department said in a news release. The shooting happened around 4:35 p.m. in the area of MacDonald Avenue and Scherwin Street.Officers arrived at the scene and located a man suffering from multiple gunshot wounds, police said. With help from the Daly City Fire Department, the victim was taken to a hospital where he is listed in critical condition. Osiel Cota was last seen at the playground at Orange Park, police said.He is described as being in his mid-twenties, 5 feet tall and 190 pounds. He has special needs and a limited vocabulary, according to police. A report of shots fired came in shortly before 10 p.m. In the area of Broadway and Sereno Drive, and minutes later learned a gunshot victim was taken to a hospital, according to police.
